Ethereum Halal Fatwa — Is ETH Halal in Islam?

Ethereum (ETH) is the second-largest cryptocurrency and the foundation of most DeFi and NFT activity. Its Shariah analysis is more complex than Bitcoin's because: (1) ETH has a PoS staking mechanism with yield implications, (2) Ethereum is the platform on which most riba-based DeFi protocols run, and (3) ETH itself is distinct from the DeFi activity it enables. This fatwa overview separates the spot ETH ruling from the DeFi and staking questions.

The ruling

Spot ETH ownership (purchasing ETH without staking) passes all five AAOIFI-aligned halal gates and is permissible under the same analysis as Bitcoin, extended for a smart-contract platform with defined utility (gas fees, network operation). ETH staking yields follow the staking fatwa analysis: permissible with conditions under the majority opinion, conservative-stricter position is spot-only without staking. Using ETH to interact with riba-based DeFi protocols (Aave lending, Compound) is haram — the underlying transaction is prohibited regardless of the currency used. Using ETH on a DEX for spot token swaps is permissible.

Shariah evidence

Ethereum's transition from PoW to PoS (The Merge, September 2022) changed the riba analysis slightly: post-Merge, ETH has a staking yield mechanism, which required re-analysis. The consensus from Mufti Faraz Adam and IFC UK is that the spot asset remains clean; the staking question is additive. The haram-sector gate: ETH enables DeFi, NFT platforms with haram content, and other applications. Scholars broadly hold that ETH as infrastructure is halal-neutral — analogous to electricity that powers both halal and haram businesses.
